Do You Lose Your CDL If You Get A DUI in RI?
There are severe DUI laws in RI. If you are licensed to operate a commercial motor vehicle (CMV), you automatically provide your consent to alcohol testing.
The following DUI-related conditions will result in losing your CDL for a minimum of one year:
- Operate a vehicle with a BAC of .04% or higher
- Drive under the influence of alcohol
- Drive under the influence of a controlled substance
- Refuse to take a blood alcohol test
If you are operating a CMV which is designated to transport hazardous material upon your DUI arrest, you will lose your CDL for three years. A second offense results in permanently losing your CDL. However, if you participate in a breathalyzer test and your BAC is under .04%, you will lose your right to operate the CMV for up to 24 hours.
