A criminal appeal may arise from various situations. In order to prepare for another round of court dates and legal proceedings, it is imperative to obtain the legal representation of a skilled and trustworthy lawyer.
Our attorneys have represented clients with appeals before the Rhode Island Traffic Tribunal, District Courts, and Superior Courts. They can thoroughly analyze your case and determine all of your available legal options to protect your rights, reputation, and freedom in every step of the legal process.
If you lose a hearing at the Rhode Island Traffic Tribunal for a traffic offense, you may seek an appeal with the Appeals Panel for the tribunal. You need to prepare a memorandum of law which outlines your case, states your legal issues, and argues why the panel should reverse the judge’s decision. However, if your appeal is unsuccessful, you may appeal the Panel’s decision in District Court.
If you lose a criminal trial in District Court, you may be eligible to a de novo trial in Superior Court. Instead of appealing the decision of the District Court judge, you get a brand new trial either before a judge or jury.
If you lose a criminal trial in Superior Court, you are entitled to an
appeal before the Rhode Island Supreme Court. In general, issues not raised
during your criminal trial are not subject for review by the Supreme Court
in Rhode Island. An appeal requires extensive legal research and writing,
as well as
an oral argument.
If you or a loved one has been convicted of a crime and wishes to appeal that conviction, you should contact The Law Office of Thomas C. Thomasian, Esq. right away. Having an experienced attorney on your side can make a significant difference.
