The Domestic Violence Prevention Act governs domestic violence law in Rhode Island. The complete text of the Act is found in Rhode Island General Laws Title 12, Chapter 29. There exists a common misconception that domestic violence crimes can only involve people who are in a substantial dating relationship.
While it is true that the Domestic Violence Prevention Act covers people in a dating relationship, the Act also applies to people who are roommates or people who are not in a relationship but have a child in common.
The act defines family or household member as:
"spouses, former spouses, adult persons related by blood or marriage, adult persons who are presently residing together or who have resided together in the past three (3) years, and persons who have a child in common regardless of whether they have been married or have lived together, or if persons who are or have been in a substantive dating or engagement relationship within the past one year which shall be determined by the court's consideration of the following factors: length of the relationship, type of relationship, and frequency of interaction between the parties. "
