When Can I Appeal My Conviction in RI?
If you lose a hearing at the Rhode Island Traffic Tribunal for a traffic offense, you may seek an appeal with the Appeals Panel for the tribunal. You need to prepare a memorandum of law which outlines your case, states your legal issues, and argues why the panel should reverse the judge’s decision. However, if your appeal is unsuccessful, you may appeal the Panel’s decision in District Court.
If you lose a criminal trial in District Court, you may be eligible to a de novo trial in Superior Court. Instead of appealing the decision of the District Court judge, you get a brand new trial either before a judge or jury.
If you lose a criminal trial in Superior Court, you are entitled to an appeal before the Rhode Island Supreme Court. In general, issues not raised during your criminal trial are not subject for review by the Supreme Court in Rhode Island. An appeal requires extensive legal research and writing, as well as an oral argument.
